14. APPLICABLE LAW - DISPUTE – MEDIATION
The Site and the present Terms and Conditions are subject to French law.
Any dispute that may arise concerning the interpretation and/or execution of this Legal Notice must be settled out of court.
In the absence of an amicable settlement, the dispute will be submitted to the Commercial Court of Paris, to which the Parties attribute exclusive jurisdiction, notwithstanding multiple defendants or claims for compensation from third parties.
15. MISCELLANEOUS
a. WAIVER
The fact that one of the Parties does not avail itself of a clause of the present Terms and Conditions shall not be interpreted as a temporary or definitive renunciation of the benefit of the provision in question, which shall remain in force.
b. INVALIDITY OF THE CLAUSE
If one or more of the stipulations of the present Terms and Conditions is declared invalid, void or unwritten, in application of the regulations in force, the other stipulations will retain all their force and scope, the parties undertaking as soon as possible to put in place a valid replacement provision with an equivalent scope as close as possible to the spirit of the present.
c. FORCE MAJEURE
VinFast shall be released from any liability arising from any breach of an obligation under these Terms and Conditions, the performance of which is prevented by reason of force majeure, war, fire, flood, explosion, epidemic, pandemic, civil riot, popular movement, import or export regulations or embargoes, strikes, or other industrial or trade disputes, acts of terrorism or governmental action or disruption of public services or any other cause beyond its reasonable control.
