ARTICLE 1 - Preamble
VINFAST FRANCE, a société par actions simplifiée unipersonnelle with share capital of € 26643000, having its registered office at 72 RUE DU FAUBOURG SAINT HONORE 75008 PARIS 8, registered in the Paris Trade and Companies Register under number 893 573 535,
In order to promote the sale of its first model available on the European market, the VF 8, VinFast wished to reward its first customers in France with a promotional offer of limited duration with an obligation to purchase entitled " Boundless Journey " (hereinafter referred to as "the Offer").
Participation in this Offer implies express and unreserved acceptance of these terms and conditions in all their stipulations, as well as the laws and regulations in force on French territory.
ARTICLE 2 - Conditions of participation
This Offer is intended for all adults who are consumers within the meaning of the introductory article of the French Consumer Code, who have full legal capacity within the meaning of articles 1145 et seq. of the French Civil Code, who reside in mainland France including Corsica and who have purchased a new VF 8 vehicle between 1 February 2024 and 31 March 2024 inclusive.
Participation in this Offer is subject to the creation of a VinFast account (hereinafter referred to as the "VinFast Account"), installation of the VinFast Application and acceptance of their respective General Terms and Conditions of Use. If eligible, the Participant must also accept VinFast's Public Charging general terms and conditions.
This Offer is limited to the first 150 VinFast customers (hereinafter the "Eligible Participants") on the order confirmation date.
To be taken into account, the order must be definitive and the Customer must not have exercised any right of withdrawal. The Customer may only benefit from the Offer from the date of delivery of the vehicle ordered.
Customers who have made a reservation for a VF 8 before the start of the Offer and then converted this reservation from the start of the Offer are eligible, under the conditions set out in these Terms and Conditions.
VinFast Customers already benefiting from the VinFirst promotional programme are not eligible for the Offer, which is not cumulative.
VinFast reserves the right to ask any participant to justify the conditions set out above. Any person who does not meet these conditions or refuses to provide proof will be excluded from eligibility for the Offer.
ARTICLE 3 - How do I purchase a VF 8?
VF 8 can only be purchased through the following two separate sales channels:
- The official VinFast website at https://vinfastauto.eu/fr/vehicles/vf-8
- One of VinFast's physical points of sale (hereinafter the "Showroom(s)") throughout France, with the exception of independent car dealerships that have joined VinFast's selective distribution network, where applicable.
The Participating Showrooms are as follows:

ARTICLE 4 - Duration of the Offer
This Offer is valid from its publication date within the limit of all the Prizes that may be awarded under the conditions set out in these Terms and Conditions.
ARTICLE 5 - Prizes awarded
150 Prizes of one Endowment each may be awarded over the duration of this Offer.
Each Prize consists of a voucher with a unit value of €2,500 (Two thousand five hundred euros) that can only be used on the recharging network accessible with the VinFast application from 1er February 2024.The Gifts are valid for 3 years from their first use under the conditions defined in the Article below.
The Eligible Participant undertakes to accept the Prize as offered without the possibility of exchanging it for cash, other goods or services of any kind whatsoever or transferring the benefit to a third party.
Similarly, this Allocation may not be the subject of requests for compensation.
The Prize may not be sold or transferred to a third party or parties, except with the agreement of VinFast.
In the event of force majeure or exceptional circumstances beyond its control, in particular linked to its suppliers or unforeseeable circumstances, VinFast reserves the right to replace the Prize won with a Prize of equivalent nature and/or value.
Eligible Participants will be kept informed of any changes.
ARTICLE 6 - Use of the Prizes
The Prizes may be used throughout the recharging network accessible with the VinFast application (hereinafter the "Recharging Network")" from 1er February 2024.
Participants who are eligible for the Offer will be determined instantly upon confirmation of their order by VinFast, which will notify them of this information in writing to the contact details they provided when purchasing their VF 8 or when creating their VinFast Account.
VinFast will then send a physical card with integrated radio frequency identification (RFID) technology. Once the card has been received, the eligible Participant must activate their personal card by connecting it to their VinFast Application.
Once the card has been activated, the eligible Participant will then be free to use the €2,500 credit within the Recharge Network. They can check their available balance in real time at any time by consulting the dedicated tab on the VinFast Application.
The credit is valid for 3 years from the first top-up.
When the balance is less than €200, the Eligible Participant will receive a personalised notification from VinFast on his/her application to inform him/her of this. When the balance is exhausted, the eligible Participant will be debited under the normal conditions of use of the Public Charging service to the bank account that he/she will have entered beforehand.
If one of the Participants who is eligible for the offer decides, after having received delivery of his vehicle, to exercise their right of withdrawal where the situation allows, they will automatically lose the benefit of this Offer.
the benefit of this Offer will then be automatically passed on to the next eligible VinFast customer.
ARTICLE 7 - Determination of eligible Participants
Participants who are eligible for the Offer will be determined instantly upon confirmation of their order by VinFast, which will notify them of this information in writing to the contact details they provided when purchasing their VF 8 or when creating their VinFast Account.
Eligible Participants will also be contacted individually so that VinFast can arrange the delivery of the Prizes when the vehicle ordered is delivered.
If the eligible Participant(s) do not come forward within 21 days of VinFast's notification to award the Prize, VinFast may freely award the Prize to the next eligible Participant, who will be determined by chronological order when the order is placed, without VinFast being held liable in any way.
VinFast will nevertheless use its best efforts to contact the eligible Participant.
ARTICLE 8 - Acceptance of these Offer Terms and Conditions
Participation in this Offer implies full and unreserved acceptance of these Offer Terms and Conditions.
Any fraud, attempted fraud or failure to comply with these Terms and Conditions will result in the immediate and automatic ineligibility of the perpetrator, with VinFast reserving the right, where applicable, to take legal action against the perpetrator, to the fullest extent permitted by law.
ARTICLE 9 - Terms and conditions
VinFast reserves the right to extend, shorten, modify or cancel this Offer at any time, in particular in the event of force majeure, without participants being entitled to claim any compensation.
ARTICLE 10: Industrial and intellectual property
The reproduction, representation or use of all or part of the elements making up the Offer, including these Terms and Conditions, is strictly prohibited.
ARTICLE 11: Liability
VinFast may not be held liable in the event of force majeure or unforeseen circumstances beyond its control.
VinFast cannot be held responsible for delays, loss, theft, damage to mail or illegibility of postmarks due to the postal services. VinFast shall not be held liable and no recourse may be taken against it in the event of the occurrence of force majeure events (strikes, bad weather, etc.) partially or totally depriving Participants of the possibility of benefiting from the Offer.
VinFast and its service providers and partners may under no circumstances be held liable for any incidents that may arise from the non-compliant use of the Prizes by the beneficiaries once the eligible Participants have taken possession of them.
Similarly, VinFast and its service providers and partners may not be held liable for the loss or theft of the Prizes by eligible Participants once they have taken possession of them. Any additional cost required to take possession of the Prizes shall be borne entirely by the Eligible Participants, who may not claim any compensation whatsoever from VinFast or its service providers or partners.
This Offer is not managed or sponsored by Meta and/or LinkedIn, which VinFast accepts no responsibility for.
Article 12: Evidence agreement
By express agreement between the participant and VinFast, only VinFast's computer systems and files will be deemed authentic.
The computerised registers, kept in VinFast's computer systems under reasonable conditions of security and reliability, are considered as proof of the relations and communications between VinFast and the participant.
It is therefore agreed that, in the absence of manifest error, VinFast may rely, in particular for the purposes of proving any act, fact or omission, on programmes, data, files, records, transactions and other elements (such as monitoring reports or other statements) of a computerised or electronic nature or format, drawn up, received or stored directly or indirectly by VinFast, in particular but without limitation in its computer systems.
The elements considered thus constitute proof and if they are produced as means of proof by VinFast in any litigation or other proceedings, they will be admissible, valid and enforceable between the parties in the same way, under the same conditions and with the same evidential value as any document drawn up, received or kept in writing.
In the applicable situations, operations of any kind carried out using the identifier and code allocated to a participant, following his/her participation, are irrevocably presumed to have been carried out under the participant's responsibility.
ARTICLE 13 - Protection of personal data
Only the personal data strictly necessary for the organisation of the Offer and the awarding of the Prizes to eligible Participants by VinFast are collected. It is used exclusively for this purpose to the exclusion of all others.
This data is kept for a maximum of six (6) months from the end of the Offer for evidential purposes only.
In accordance with European Regulation no. 2016/679 on the protection of personal data (RGPD), participants may, for legitimate reasons, object to their personal data communicated in the context of this Offer being processed. They also have the right to object to their data being used for commercial canvassing purposes, outside the scope of participation in this Offer, which they may exercise as soon as they register their participation or by writing to VinFast at the address given in Article 1.
In accordance with the French Data Protection Act of 6 January 1978 and the RGPD, all participants have the right to demand that any information concerning them that is inaccurate, incomplete, ambiguous or out of date be rectified, completed, clarified, updated or deleted. On receipt of the request, VinFast checks that it is admissible in accordance with the applicable regulations.
ARTICLE 14: Disputes & complaints
These Terms and Conditions are governed by French law.
VinFast reserves the right to rule without appeal on any difficulty that may arise as to the interpretation or application of these Terms and Conditions, it being understood that no dispute will be admitted, in particular on the terms and conditions of the Offer, 6 months after the end of the Offer. Except in the case of obvious errors, it is agreed that the information resulting from VinFast's computer systems has evidential value in any dispute as regards the connection elements and the computer processing of said information relating to the Offer.
Any complaint must be sent to VinFast by post to the following address within 6 months of the end date of the Offer:

After this date, no claims will be accepted. Participation in the Offer implies full acceptance of these terms and conditions.
